1 Scott Jensen appeals a judgment based on a jurys verdict convicting him of three counts of felony Misconduct in Public Office contrary to WIS. STAT.ç 946.12(3) (2005-06), and one count of Intentional Misuse of Public Position for Private Gain as a Party to the Crime, contrary to WIS. STAT. çç 19.45(2) and 939.05. Jensen contends that the trial court submitted an erroneous jury instruction and prevented him from presenting a complete defense by excluding portions of his and his defense witnesses testimonies. We conclude that the trial court properly exercised its discretion in excluding portions of Jensens defense witnesses testimony, but erred in submitting an erroneous jury instruction and in excluding portions of Jensens own testimony. Accordingly, we affirm in part and reverse in part and remand for a new trial.
